It follows the donor's habitual residence and where their property is, not where the attorneys live. An attorney in Glasgow can act under an English LPA perfectly well, and an attorney in London can act under a Scottish power of attorney.
Why the documents differ
LPAs in England and Wales are created under the Mental Capacity Act 2005. Scotland's equivalent sits under the Adults with Incapacity (Scotland) Act 2000, and Northern Ireland has not yet replaced its older enduring powers of attorney system with anything equivalent to LPAs. The forms, the registration body and the fees are all different, so a document valid in one nation is not automatically recognised in another.
Moving between nations
- A donor who moves from England to Scotland after registering an LPA does not need a new document immediately, but a fresh Scottish power of attorney is usually sensible for future dealings there.
- A donor who owns property in more than one nation may need separate documents for each, since each registration body only recognises its own form.
Living abroad

Why this matters practically
Someone searching for an LPA online in the UK is very often based in Scotland or Northern Ireland and has not realised the document, the process and the registration body are all different. Using an England and Wales LP1F or LP1H in Scotland will not be recognised by Scottish institutions, and vice versa. Getting this right at the outset avoids paying twice.
What to do if you are unsure which applies to you
- Check where the donor is habitually resident, not where family members live.
- If the donor has moved recently, use the nation they currently live in permanently, not where they used to live.
- If in doubt, contact the relevant register — the Office of the Public Guardian for England and Wales, the OPG Scotland, or the Office of Care and Protection in Northern Ireland — before paying anyone to prepare a document.
