Privacy notice

A Lasting Power of Attorney is an intimate document. This notice explains exactly what we hold and why.

Information we collect

• Your account: email address, name, and optionally a telephone number.
• The donor: name, any former names, date of birth, address, and contact details.
• Other people named in the LPA: attorneys, replacement attorneys, the certificate provider, and anyone to be notified — their names, dates of birth where required, addresses and contact details.
• Your answers about the LPA itself: how attorneys should act, when the powers begin, any preferences or instructions, and — on a Health & Welfare LPA — the donor's decision about life-sustaining treatment. That last item is health data and we treat it with particular care.
• Your free eligibility check answers, including anything you flagged about capacity or complexity, which we keep so we can show why we did or did not proceed.
• Payment records. Card details are handled by our payment provider and never reach our systems.

Why we hold it, and our lawful basis

We hold this information to perform our contract with you: we cannot produce a Lasting Power of Attorney without it. Where the information is health data — the life-sustaining treatment decision, or anything you tell us about a medical condition — we rely on your explicit consent, which you give by entering it, and you may withdraw that consent by deleting the answer or asking us to delete your application.

We keep records of what we produced and when, and of your acceptance of our terms, because we have a legitimate interest in being able to evidence what we did.

Who we share it with

Nobody, except the service providers who host our systems and process our payments, and only to the extent needed to run the service. We do not sell your information, we do not share it with marketers, and we do not send your documents to the Office of the Public Guardian — you do that yourself.

How long we keep it

We keep your application and your generated documents for seven years from your last activity, so you can obtain a fresh copy if the original is lost and so we can evidence our work. You can ask us to delete it sooner. Answers to the free eligibility check given before you create an account are held only in your own browser and are discarded when you close it.

Your rights

You may ask for a copy of what we hold, ask us to correct it, ask us to delete it, ask us to restrict what we do with it, or object to our holding it. You may also withdraw consent to our holding health data. Contact us and we will respond within one month. If you are unhappy with how we have handled your information you may complain to the Information Commissioner's Office.

If you are entering someone else's details

If you are the account holder and not the donor, you should tell the donor and the other people you name that their details are being entered here, and show them this notice.
