Terms of service

These terms apply when you buy document preparation from LPAs Online. Please read them alongside what we do and do not do, which forms part of these terms.

1. Who we are and what we are not

LPAs Online is a document preparation service for Lasting Powers of Attorney in England and Wales. We are not a firm of solicitors and we are not regulated by the Solicitors Regulation Authority or any other legal regulator. We do not provide legal advice. We are not connected with, endorsed by, or acting for the Office of the Public Guardian or GOV.UK.

2. The account holder and the donor

The account holder is the person who creates the account and pays us. The donor is the person the Lasting Power of Attorney belongs to. They may be the same person or different people. If you are the account holder and not the donor, you confirm that the donor knows about the application, makes their own decisions about its content, and will sign it themselves.

3. What we provide

For the fee set out in clause 4 we provide: the guided question set; eligibility checks on the people you name; checks on preferences and instructions wording; an internal consistency check; the populated official Office of the Public Guardian forms; and a personalised signing and registration pack. We will correct and reproduce your documents as many times as you need before you send them for registration.

4. Fees

Our fee is £49 for one Lasting Power of Attorney or £79 for both. It is payable before we produce your documents. The Office of the Public Guardian charges a separate registration fee of £92 for each Lasting Power of Attorney. That fee is not ours, is not included in our price, and is paid by you directly to them. Reductions and exemptions from that fee may be available depending on the donor's income and benefits.

5. Your right to cancel

As a consumer buying at a distance you normally have 14 days from purchase to cancel and receive a refund. If you ask us to begin immediately — which we ask you to confirm expressly at checkout — you lose that right once we have produced your documents. If you cancel before your documents are produced, we refund you in full. If our eligibility check clears you and we subsequently find we cannot prepare your documents, we refund you in full.

6. Your responsibilities

You are responsible for the accuracy of the information you give us. We cannot verify names, addresses, dates of birth, or anyone's identity. You are responsible for printing the documents, arranging signatures in the correct order, and sending the signed originals to the Office of the Public Guardian with the registration fee.

7. Limits of our responsibility

If your application is rejected because of an error we made in producing documents from information you supplied correctly, we will correct the error and reproduce your documents at no charge. Beyond that, our total liability to you is limited to the fee you paid us. We are not responsible for the consequences of your decisions about the content of your Lasting Power of Attorney, for delays or decisions of the Office of the Public Guardian, or for the acts of your attorneys or certificate provider. Nothing in these terms limits liability that cannot lawfully be limited.

8. Your data

We hold what you enter so you can return to it and so we can produce your documents. Our privacy notice explains what we hold, why, and for how long.

9. Complaints and governing law

If something has gone wrong, contact us and we will respond. Because we are not a regulated legal services provider, the Legal Ombudsman cannot consider complaints about us. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
