The short answer

"Power of attorney" covers several documents; for most people in England and Wales today it means a Lasting Power of Attorney (LPA).

You can prepare an LPA entirely online, but the donor, attorneys and witnesses must still sign on paper, in the correct order.

An online-prepared LPA is just as legally valid as one prepared by a solicitor, provided it's completed and signed correctly.

"Power of attorney" isn't one document

Power of attorney is the umbrella term for giving someone else legal authority to act for you. In England and Wales there are three different versions of it, and only one of them is what most people searching for this actually need:

Lasting Power of Attorney (LPA) — the modern document, made since October 2007, that continues to work even if the donor loses mental capacity. This is what LPAs Online prepares.
Ordinary (general) power of attorney — only valid while the donor still has mental capacity, often used for a specific short period, such as while someone is abroad.
Enduring Power of Attorney (EPA) — made before October 2007 and no longer possible to create new, but an existing EPA can still be used and registered if needed.

Scotland and Northern Ireland are different

This page, and LPAs Online generally, covers England and Wales only. Scotland uses Power of Attorney under different legislation, and Northern Ireland has its own Enduring Power of Attorney system — the forms and process are not interchangeable.

What "online" actually means here

An online LPA service handles the parts of the process that can genuinely be done on a screen: answering questions about the donor and attorneys, choosing how attorneys act, adding preferences and instructions, and generating the correctly formatted forms. What it cannot do is the signing — by law, the donor, certificate provider, attorneys and witnesses must sign the physical paper form, in person, in the correct order. Nobody offers a fully digital, wet-signature-free LPA, because the underlying law does not currently allow it.

Is an online LPA legally valid?

Yes. There is nothing in the Mental Capacity Act 2005 that requires an LPA to be drafted by a solicitor. What makes an LPA valid is that it uses the correct OPG-approved forms (LP1F and/or LP1H), is signed by the right people in the right order, and is registered with the Office of the Public Guardian. Preparing that paperwork through an online service, rather than by hand or through a solicitor, makes no difference to its legal standing once it's registered.

Is it safe to make an LPA online?

The paperwork you complete online only ever leaves your device as far as generating your own documents — there is no court filing or third-party disclosure at that stage. The parts that matter most for safety are the same whether you use a solicitor or an online service: choosing attorneys you genuinely trust, and having a certificate provider who can honestly confirm the donor understands the document and isn't under pressure.

Who shouldn't use an online service

Anyone where there's genuine doubt about the donor's mental capacity to make the decision — this needs a professional capacity assessment first.

Anyone who wants tailored legal advice rather than a standard, OPG-approved form.

Common questions

Is an LPA made online legally the same as one made by a solicitor?

Yes. What matters legally is that the correct OPG forms are used, signed by the right people in the right order, and registered with the Office of the Public Guardian — not who typed it up.

Can I complete the whole LPA process without printing anything?

No. UK law currently requires the donor, certificate provider, attorneys and witnesses to sign on paper, in person, in the correct sequence. Online services prepare the document but cannot replace the physical signing.

Is power of attorney online the same in Scotland?

No. This covers England and Wales only. Scotland has its own Power of Attorney legislation and forms, and Northern Ireland has a separate Enduring Power of Attorney system.

What's the difference between an LPA and an old Enduring Power of Attorney?

An EPA could only be made before October 2007 and only covers financial matters. LPAs replaced them, cover a wider range of decisions including health and welfare, and are the only version you can create today.

Can I use an ordinary power of attorney instead of an LPA?

Only if you still have mental capacity and only for as long as you keep it — an ordinary power of attorney automatically ends if the donor loses capacity, which is exactly the situation an LPA is designed for.
