They have capacity and want to make one

They have already lost capacity
An LPA can no longer be made — not by us and not by anyone else. The route is a deputyship application to the Court of Protection.
If he is reluctant
- An LPA changes nothing while he has capacity — the financial one can be set to be used only if he can no longer decide.
- He chooses the attorneys, not you, and he can revoke it at any time while he has capacity.
- Without one, decisions pass to the Court of Protection, which is slower and more expensive than anything he is being asked to sign now.
- He can appoint two people who must act together, if a single attorney feels like too much power in one pair of hands.
Pressure invalidates the document
An LPA made under pressure can be set aside, and the certificate provider is there specifically to check the donor is acting freely. If he does not want one, that is his decision to make.
The practical steps
- Choose your LPA together — no account needed until after you pay.
- Agree which LPA he wants: money, health, or both.
- Work through the wizard with him, in his words.
- Arrange the certificate provider and witnesses.
- Post the signed original to the OPG with the fee.
Common objections, and what actually answers them

| "It's too soon, I'm fine" | That is exactly the right time to make one — an LPA cannot be made once capacity is already lost. |
A worked example
David, 74, kept putting his LPA off for a year, worried it meant admitting decline. His son Tom stopped raising it as a task and instead asked David directly who he would want making decisions if he had a stroke tomorrow. David named Tom and his sister Anne, jointly and severally, and completed the wizard himself with Tom typing while David spoke.
The whole process, from that conversation to posting both LP1F and LP1H, took about three weeks — most of it waiting for a convenient date with the certificate provider, David's GP.
Common questions
He says he will do it later. What do I say?
Ask what happens if he cannot decide later — a stroke or a fall does not wait for a convenient time. An LPA made now costs nothing to sit unused; the alternative if capacity is lost first is a Court of Protection deputyship, which is slower and more expensive.
Can I make it for him if he refuses to engage?
No. Only he can decide who his attorneys are and only he can sign section 9. If he genuinely will not engage, there is nothing to make yet — this is his decision, not yours.
