The mistake couples make

Appoint replacements as well as each other

If you appoint only each other and you are both in the same car accident, neither LPA works. Naming an adult child or trusted friend as replacement attorney costs nothing extra and covers exactly that scenario.

Bear in mind too that spouses are often of similar age — the person you appoint may lose capacity around the same time you do.

Marriage alone changes nothing legally

Being married does not give either of you authority over the other's sole bank account, a pension in one name, or a house held solely by one spouse. Banks and the Land Registry look for a registered LPA or deputyship order, not a marriage certificate. This is why each spouse needs their own documents even in a long, close marriage.

A worked example

James and Linda made all four documents together in one evening, appointing each other first and their son as replacement attorney on every document. They paid £158 to us and, six weeks later, £368 to the OPG once both sets were registered.

Doing it together: the practical order

Sit down together and agree attorneys and replacements for both of you before opening any form.
Complete one LPA at a time rather than switching between the two of you, so the wording stays consistent.
Book one certificate provider appointment covering all four documents where possible, to save repeat visits.
Sign in the correct order on each document: donor, then certificate provider, then attorneys.
Post all four together, or in pairs, with separate £92 cheques or payments for each.

Edge cases for couples

If one spouse has already lost capacity, only the other can still make an LPA — see what we do not do.
Remarriage or a new civil partnership does not automatically update an existing LPA's attorney appointments.
Couples with children from a previous relationship sometimes appoint a mix of stepchildren and biological children as replacements — this is entirely permitted.

Common questions

Can we appoint our children instead of each other?

Yes, and some couples do, particularly where one spouse would find the responsibility difficult. There is no requirement to appoint your spouse at all.

Do we have to do all four documents at the same time?

No. Many couples start with financial LPAs, which tend to matter first, and add the health LPAs afterwards. Each document is registered on its own.
