Yes. There is no requirement for an attorney to live in England and Wales, or in the UK at all. The limits are practical rather than legal — banks, care homes and the paperwork all assume someone reachable.

What the law requires
An attorney must be 18 or over and have mental capacity. For a Property & Financial Affairs LPA they must not be bankrupt or subject to a debt relief order. Nationality and residence are not part of the test.
The practical problems
- Banks often want to see original documents or the attorney in branch

- Property sales involve signing documents that can be slow to post overseas
- Some overseas addresses complicate identity checks with UK institutions
The usual solution
Appoint the overseas person alongside someone in the UK, jointly and severally. Either can act alone, so the day-to-day work falls to whoever is nearest and nothing waits for a signature in the post.
Signing when someone is overseas
Each attorney signs their own section of the LPA, in front of a witness, and they do not all have to sign at the same time or place. The order matters — the donor signs before the attorneys — so the paperwork usually travels rather than the people. Banks, identity checks and money
The clearest practical problem is banking. UK banks generally want to register the LPA against the donor's account and then verify the attorney's identity before releasing any access. If the attorney lives overseas, many banks still ask for certified identity documents, a UK-format proof of address, or occasionally an in-branch visit — none of which are quick to arrange from another country. Some banks are more flexible with digital verification than others, so it is worth checking with the specific bank once the LPA is registered rather than assuming the process will be smooth.
Time differences compound this. An overseas attorney trying to authorise an urgent payment, query a fraud block, or attend a scheduled bank call may find UK opening hours fall in the middle of their night, which slows down exactly the moments that need to be fast.
Time zones and health decisions
For a Health & Welfare LPA, the harder problem is not paperwork but presence. A hospital wanting a decision about treatment, or a care home reporting a fall, usually wants an answer within hours, not days. An attorney twelve time zones away may be asleep when the call comes, and even once awake cannot attend in person to see the donor, speak to the consultant face to face, or sign a consent form on the ward that afternoon.

- An attorney who cannot visit may end up relying entirely on secondhand reports from care staff or a co-attorney
- Long-haul time differences mean urgent calls often land at 3am for the overseas attorney
When a UK-based co-attorney or replacement solves it
None of this means an overseas attorney is a bad choice — often they are the most trusted person, or the one with the time to take on the role. The fix is structural rather than legal: pair them with someone in the UK.

Jointly and severally is what makes this work
If the overseas and UK attorneys are appointed jointly, every decision still needs both signatures, which reintroduces the delay you are trying to avoid. Jointly and severally lets the UK attorney act alone when speed matters, while the overseas attorney remains fully able to act too.
Where this goes wrong on the form
- Appointing only an overseas attorney with no UK-based attorney or replacement, then finding no one can attend urgently
- Choosing 'jointly' for an overseas and a UK attorney, which forces every decision to wait for both
- Assuming a UK power of attorney is automatically recognised abroad — that depends on the other country's own rules
- Not checking with the donor's bank in advance whether it can verify an attorney who lives outside the UK
Worked example
Helen's son Marcus lives in Singapore and her daughter Julie lives twenty minutes from her in Bristol. Helen wants Marcus involved — he manages her investments already — so she appoints Marcus and Julie jointly and severally on the Property & Financial Affairs LPA, and Julie alone on the Health & Welfare LPA with Marcus as replacement. If Helen has a fall, Julie can get to the hospital that afternoon and make an urgent decision; Marcus stays fully involved in managing her savings and can act on either LPA if Julie is ever unavailable.
Common questions
Does the witness have to be in the UK?
No, but the witness must be 18 or over and cannot be an attorney or replacement attorney under the same LPA.
Does the LPA work abroad?
An LPA made in England and Wales covers decisions here. Other countries may or may not recognise it, which is a question for local advice in that country.
Will a UK bank refuse to deal with an overseas attorney?
Not necessarily, but many banks ask for identity checks or documents that are slower to arrange from abroad. Check with the specific bank once the LPA is registered.
Can an overseas attorney make health decisions by phone or video call?
Sometimes — clinicians increasingly accept remote consent — but this is not guaranteed, and it does not replace being physically present when that matters most.
