How long does LPA registration take?

Expect a couple of months from posting the forms to holding a registered LPA. Part of that wait is built into the law and cannot be shortened by paying anyone more.

The stages

  1. Complete the forms. With us, usually one sitting.
  2. Signing, in the right order. Donor first, then the certificate provider, then the attorneys. How long this takes depends entirely on how quickly you can get people together.
  3. Notify anyone named in section 6, if you named anyone, using form LP3.
  4. Post the application to the OPG with the fee or a fee-reduction claim.
  5. Statutory four-week waiting period. The OPG must wait to allow objections before it can register.
  6. Checking and registration. The OPG reviews the document, then returns it stamped as registered.

Nothing works until it comes back

Until the registered document is returned, no attorney can use the LPA. Banks, care homes and hospitals will refuse an unregistered one. If you are making an LPA because help is needed soon, start now rather than waiting for a crisis.

Current timescales

The OPG publishes its current processing time on GOV.UK, and it moves with demand. Historically it has ranged from around eight weeks to considerably longer during backlogs. Treat any figure you read anywhere — including here — as indicative and check the OPG's published time before making plans around it.

What actually causes delay

  • Signatures in the wrong order — this makes the LPA invalid and everyone must sign again.
  • A missing signature or date, or a missing continuation sheet.
  • An ineligible certificate provider, most often a relative. Check the rules.
  • Instructions the OPG considers unclear, unlawful or contradictory.
  • A fee-reduction claim without the required evidence.

If it is rejected

The OPG returns the document explaining what is wrong. Depending on the fault you may need to correct and re-sign the whole LPA and pay the registration fee again — so the cheapest version of this process is the one that goes right first time.
