Can I have more than one LPA?

You can hold both types at once. Two of the same type is where it gets messy.

The straightforward case

One Property & Financial Affairs LPA plus one Health & Welfare LPA is the normal arrangement, and they can name different attorneys. See do both LPAs need the same attorneys.

Two of the same type

  • Legally possible, but both remain on the register until one is revoked.
  • Providers may not know which to follow, causing delay.
  • A later LPA does not automatically cancel an earlier one.
  • Best practice: revoke the old one by deed and tell the OPG.

Always revoke explicitly

Assuming the newest document wins is the most common error when people remake an LPA after a family change.

Old EPAs

An Enduring Power of Attorney made before October 2007 remains valid alongside a new Health & Welfare LPA. If you make a new financial LPA, revoke the EPA to avoid two competing financial documents. See LPA vs EPA.

Can different attorneys act on each LPA?

Yes, and it is often sensible — the organised one on finances, the nearby one on health.

Do I need a new LPA to add an attorney?
